Introduction and Acceptance of Terms
1.1 These Terms and Conditions (Terms) govern your use of bootifullyou.co.uk (the Website).
1.2 The Website is owned and operated by Bootifullyou, owned and operated by Lewis Bacon and Andrea Faulkner (sole traders) (we, us, our).
1.3 By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website.
1.4 These Terms should be read together with our Privacy information and Cookie Policy.
1.5 Important: We are not therapists, counsellors, clinicians, or crisis services. Please read the wellbeing disclaimer in Section 7.
Definitions
2.1 Bootifullyou / Bootsie means our brand and community ritual encouraging people to share a photo or short video of how they move or rest (boots, shoes, socks, wheels, prosthetics, bare feet, etc.) together with one honest line about where they are at that day.
2.2 Content means all text, images, videos, audio, and other material on the Website.
2.3 User Content means content you submit to us directly (for example by email or contact form), or content you post on social media that you tag for Bootifullyou’s attention, including content posted publicly using #Bootsie and/or #Bootifullyou and/or tagging @walkwithbootsie.
2.4 Social Platforms means third-party services such as Instagram and Facebook.
Eligibility and Age Requirements
3.1 The Website is intended for users aged 13 and over.
3.2 If you are 13 or under, you must have permission and supervision from your parent, guardian, or caregiver to use the Website and to participate in Bootsie activities.
3.3 We do not knowingly collect personal data from children under 13 without appropriate consent. If you believe a child has provided us personal data without appropriate consent, please contact us so we can address it.
Acceptable Use
4.1 You must use the Website lawfully and respectfully.
4.2 You must not:
a) use the Website in any way that breaches any applicable law or regulation
b) post, submit, or encourage content that is hateful, harassing, abusive, threatening, discriminatory, sexually explicit, defamatory, deceptive, or otherwise harmful
c) bully, shame, or target others, or encourage self-harm or harm to others
d) impersonate another person or misrepresent your affiliation with any person or organisation
e) upload or share content you do not own or do not have permission to use
f) infringe the privacy or intellectual property rights of others
g) introduce viruses or attempt to gain unauthorised access to the Website or any systems
h) scrape, harvest, or collect data from the Website without permission
i) use the Website to send spam or unsolicited marketing.
4.3 We may take action if we believe you have breached these Terms, including restricting your access to the Website or refusing to feature your content.
Intellectual Property (Our Content)
5.1 Unless otherwise stated, we own or license the rights in the Website and its Content, including the Bootifullyou name, Bootsie name, logos, text, design, and branding.
5.2 You may view and use the Website for personal, non-commercial purposes.
5.3 You must not copy, reproduce, republish, distribute, or exploit any part of the Website or our Content for commercial purposes without our prior written permission.
User Content and Permission to Feature Community Posts
6.1 How content may reach us. You may share User Content with us by:
a) posting publicly on Instagram or Facebook using #Bootsie and/or #Bootifullyou and/or tagging @walkwithbootsie
b) sending content to us by email or via a Website contact form.
6.2 Your responsibilities. You confirm that:
a) you own your User Content or have all necessary rights and permissions to share it
b) if your content includes other people (especially children), you have their consent (and where relevant, parental/guardian consent)
c) your content does not breach any law or any person’s rights (including privacy, copyright, or trademark)
d) your content complies with Section 4 (Acceptable Use).
6.3 Licence you grant to us. By submitting User Content to us, or by posting content publicly using #Bootsie and/or #Bootifullyou and/or tagging @walkwithbootsie, you grant Bootifullyou a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use, reproduce, display, share, repost, publish, edit, adapt, and create extracts from your User Content for community and promotional purposes in connection with Bootifullyou (including on our Website, Instagram, Facebook, and email updates).
6.4 Credit. Where reasonably possible, we will credit you (for example by tagging your account or naming your username). Sometimes a platform’s format may limit how credit appears.
6.5 Our discretion and moderation. We have the right, but not the obligation, to moderate, refuse, remove, or stop featuring any User Content at any time, including if we believe it breaches these Terms or is not appropriate for the Bootifullyou community.
6.6 Removal requests. If you would like us to remove your content from our Website or our own social channels, contact us at the email address in Section 14 with enough detail to identify the content. We will make reasonable efforts to remove it from places we control. We cannot guarantee removal from third-party accounts or from shares made by other users.
Wellbeing and Mental Health Disclaimer (Important)
7.1 Bootifullyou is a community project for general reflection, connection, and encouragement. It is not medical, psychological, clinical, or therapeutic support.
7.2 We are not therapists, counsellors, clinicians, or crisis services. Nothing on the Website, in our emails, or on our social channels is medical advice, psychological advice, counselling, diagnosis, or treatment.
7.3 Do not rely on Bootifullyou as a substitute for professional help. If you are concerned about your mental health, seek support from a qualified professional (such as your GP) or other appropriate services.
7.4 We do not provide emergency support. If you are in immediate danger or at risk of harming yourself or someone else, call 999 (UK) immediately. If you need urgent emotional support, you can contact Samaritans on 116 123 (UK).
7.5 You acknowledge that any participation in Bootsie activities is voluntary and at your own discretion and risk.
No Guarantees
8.1 We do not guarantee that the Website or any Content will always be available, complete, accurate, or up to date.
8.2 We do not guarantee any specific outcomes (emotional, mental, financial, social, or otherwise) from engaging with Bootifullyou or the Bootsie ritual.
Third-Party Links and Social Platforms
9.1 The Website may include links to third-party websites or embedded content (for example, Instagram or Facebook). Those third parties control their own services, terms, and privacy practices.
9.2 We are not responsible for third-party websites, platforms, or their content. Your use of third-party services is at your own risk and subject to their terms.
Limitation of Liability
10.1 Nothing in these Terms limits liability that cannot be limited under law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
10.2 Subject to 10.1, to the maximum extent permitted by law, we are not liable for any loss or damage arising from your use of (or inability to use) the Website, including indirect or consequential losses.
10.3 Subject to 10.1, if we are liable to you for any reason, our total liability is limited to £250.
Indemnity
11.1 If you breach these Terms, you agree to reimburse us for reasonable losses, costs, and expenses (including legal fees) resulting from your breach, including any claims made against us arising from your User Content or your unlawful conduct.
Changes to the Website and These Terms
12.1 We may update the Website and these Terms from time to time.
12.2 If we change these Terms, we will update the Last updated date at the top. Your continued use of the Website after changes means you accept the updated Terms.
Governing Law and Jurisdiction
13.1 These Terms are governed by the law of England and Wales.
13.2 The courts of England and Wales have exclusive jurisdiction over disputes arising out of or in connection with these Terms or the Website.
